Terms of Use

These terms cover version 1.0.1 of the Little Waves iPhone and iPad app and the Little Waves website.

Last updated: 7 October 2026

1. Agreement to these terms

These Terms of Use are an agreement between you and Mimi Studio d.o.o., a limited liability company organized under the laws of the Republic of Slovenia, with its registered office at Ulica Gubčeve brigade 74, 1000 Ljubljana, Slovenia ("Mimi Studio", "we", "us"), governing your use of the Little Waves mobile application and the littlewavesapp.com websites (together, "the Service").

By downloading, installing or using Little Waves you agree to these terms. If you do not agree, do not use the Service.

2. Little Waves is information, not medical advice

Please read this section.

Little Waves describes typical child development in the first two years and shows you where your own baby's days sit against published research. Every statement about development in the app carries a citation to the research it comes from, and a page in the app lists what we deliberately do not claim.

It is not medical advice, diagnosis or treatment, and it is not a substitute for a pediatrician, midwife, health visitor or any other qualified professional.

You use Little Waves at your own judgement, as one source among the people who know your child.

3. Who may use it

Little Waves is for parents and legal guardians. You must be at least 16 years old to use it, and where your law requires it and you are under 18, only with the consent of your own parent or legal guardian. It is not designed for children and is never presented to them.

By entering information about a child you confirm that you are the child's parent or legal guardian, or are acting with their authority. If you join a family as an invited caregiver, you act with the authority of the plan owner who invited you (section 6).

4. Your account

Most of Little Waves works without an account: the due date, the waves, the Firsts and the diary live on your phone. An account is offered only after a purchase is confirmed, for account-linked paid access, or to a person who accepts a family invitation (section 6). Signing in does not back up or recover local child history; only a child you share with your family is held on our server, and only while it is shared. You are never required to create an account to use what is free.

We confirm your account with a one-time code sent to your email; Little Waves does not use an app password. Tell us promptly if you believe your email has been used without your permission. Request account deletion through Settings → Account → Delete account. A request may remain pending, and the app tells you when it has completed. It asks our analytics service to delete the profile and events linked to your account, including the child information in that profile. The request is retried until the provider confirms profile deletion or that no profile remains; event deletion is queued by the provider. The app tells you if processing is still outstanding. Attribution records held by Singular require the separate request described in the Privacy Policy. Account deletion leaves local child history on this device and does not cancel store billing. If you are a family's plan owner, it also ends the family and erases every shared child for all its members; if you are an invited caregiver, it erases what you shared (Privacy Policy, section 12). Separately, Settings → Baby profile → Delete child data from this device removes the selected child's local records on success. If the device cannot write the change, the deletion fails and nothing is removed. The Privacy Policy describes the scope and limits of deletion.

5. Subscriptions and payment

5.1 What is free and what is not

On the due date alone, the core of Little Waves works: which wave is open, what tends to appear in it, when most babies are through it, what opens next, the Timeline and Why today? You can explore it without logging anything, an account or a subscription.

Free includes the six Waves, Wave details, the Timeline, Why today?, browsing 101 Firsts, and one new entry a day: a First, a signal day or a check-in. Premium adds unlimited daily logging and writing Diary notes, Swell detection from your logs, personal recaps, practical guidance and 77 activities. It also includes family sharing (section 6) for the people you invite, at no extra charge.

Whatever your subscription status, saved Diary entries, history, recaps and the Book of Firsts remain readable and exportable. We do not lock away what you entered for payment, and we will not.

5.2 Plans

Little Waves offers three plans:

Current prices are shown in the app and on our website in your local currency, set for your store territory. In the United States they are $19.99 a month, $49.99 every three months and $99.99 a year. Any special annual offer shown before purchase is also a renewing subscription, at its displayed price.

Little Waves offers no free trial.

One subscription covers the child profiles in the app and the family members you invite. No one you invite pays again: they use the paid features through your plan, for as long as it is active (section 6).

5.3 How you are billed

A renewing subscription renews automatically for the same period unless cancelled at least 24 hours before the current period ends.

5.4 Cancelling

Where you bought it is where you cancel it.

Deleting your Little Waves account does not cancel your subscription, and we have no technical ability to cancel an Apple or Google subscription on your behalf. If you delete your account without cancelling, you will continue to be charged.

Cancelling stops future renewals. You keep access until the end of the period you have already paid for. A legacy non-renewing 24-month pass, if you previously bought one, has nothing to cancel and ends when its paid period ends; it is not offered among the current plans.

5.5 Refunds

5.6 Price changes

We may change prices. A change never affects a period you have already paid for or a legacy non-renewing pass already bought, and we will give you notice before it takes effect so that you can cancel.

6. Your family and your partner

Family sharing is optional. If you bought a plan (the "plan owner"), you can invite a partner or another caregiver from Settings → Family sharing. Each invitation is a code that can be used once, by one person, within 24 hours, and you can cancel it before it is used. The person you invite signs in with their own email address and makes no purchase.

You decide what is shared, child by child. Joining a family shares nothing about a child. The plan owner chooses each child to share and agrees to it; each invited person then accepts that child for themselves. Once a child is shared, everyone who accepted it can see its shared history and add to it. The Privacy Policy (section 7) lists exactly what is shared, where it is held, and what each way of stopping erases.

Your responsibility for whom you invite. Invite only people you trust with your child's information, and only people who may lawfully have it. You are responsible for passing on an invitation code only to the person you mean it for. Anyone who joins must be at least 16 and accepts these terms for their own use. A caregiver acts with your authority as the child's parent or guardian.

One subscription. The people you invite get the paid features through your plan. Their access ends:

When their access ends, what is already on their phone stays readable and exportable to them. We cannot recall copies a family member has already downloaded or exported.

Shared content. What each person adds to a shared child stays theirs (section 7). Nobody can change or delete another person's entries. By sharing, each of you allows the others in the family who accepted the child to see what you added, and allows us to store it and show it to them.

7. Your content

The diary entries, notes, custom Firsts and logs you add ("your content") are yours. You grant us a licence to store, process and display your content to you and, for a child you share, to the family members who accepted that child, for the purpose of running the Service, and to include it in exports you request. The licence ends when the content is deleted, subject to the retention set out in the Privacy Policy.

Export is available whatever your subscription status. Settings → Export everything opens Diary and its Book of Firsts export. Settings → Save a copy of your history offers text and JSON copies of the selected child's history. The JSON includes the profile/dates, Firsts, signals, check-ins, diary sections, Swell episodes and saved recaps. Exports exclude photo files, activity-completion history, account/billing data, consent records and app settings. They are manual copies, not automatic backup or account recovery.

Do not add content you do not have the right to add, or content about a child you are not entitled to act for.

8. What you may and may not do

Little Waves is licensed to you for personal, non-commercial use. You may not:

9. Availability

We aim to keep Little Waves working but do not guarantee it will be uninterrupted or error-free. We may change, suspend or discontinue features. If we discontinue the Service entirely while you hold a paid plan, we will refund the unused portion, and you will be given the chance to export your content first.

10. Content and intellectual property

All content in Little Waves other than your content — the wave descriptions, the Firsts and activities catalogue, the answers, the illustrations, the software, and the Little Waves name and marks — is owned by Mimi Studio or its licensors and protected by copyright and trade mark law. Nothing in these terms transfers ownership of any of it to you.

The research the app cites belongs to its authors and publishers; the citations are provided so that you can read it.

Any feedback or suggestion you send us may be used without obligation or compensation to you.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will meet your requirements, that any particular result will be achieved, or that its content is accurate or complete for your child's circumstances. Section 2 applies in full.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under applicable law. If you are a consumer, your statutory rights are unaffected.

12. Limitation of liability

To the maximum extent permitted by applicable law, Mimi Studio and its directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising out of your use of the Service.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or EUR 50.

Section 11's final paragraph applies here too.

13. Indemnity

You agree to indemnify Mimi Studio against claims arising from your breach of these terms or your misuse of the Service. This does not apply to the extent a claim results from our own act or omission.

14. Termination

You may stop using Little Waves and delete your account at any time. We may suspend or terminate your access if you materially breach these terms; where the breach can be cured we will give you a reasonable opportunity to cure it first, and in any case you will be able to export your content. Sections 7, 10, 11, 12, 13 and 15 survive termination.

15. Governing law and disputes

These terms are governed by the law of the Republic of Slovenia, without regard to its conflict-of-law rules, and the competent courts of Ljubljana, Slovenia have exclusive jurisdiction.

If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory law of your country of residence, nor of the right to bring proceedings there. The European Union's online dispute resolution platform closed in July 2025 and is no longer a route; contact us first, and information about recognised consumer dispute-resolution bodies is available from the European Commission.

16. General

Entire agreement. These terms and the Privacy Policy are the whole agreement between us about the Service.

Severability. If any provision is unenforceable, the rest stands.

Waiver. Not enforcing a provision does not waive it.

Assignment. You may not assign these terms. We may assign them to a successor, on notice to you.

Changes. We may amend these terms. Material changes will be notified in the app or by email before taking effect; continuing to use the Service afterwards means you accept them.

Apple. Where you obtained Little Waves from the App Store: this agreement is between you and Mimi Studio, not Apple; Apple has no obligation to provide support or maintenance; and Apple is a third-party beneficiary entitled to enforce these terms against you.
